Swiss consultant Oliver Fricker charged in Singapore for vandalising train

oliverfrickerA Swiss business consultant was charged in court Saturday with breaking into a Singapore metro depot and spray-painting graffiti on a train, for which he could be jailed and whipped with a cane.

Oliver Fricker, 32, was accused of committing trespass and vandalism in mid-May, and a district judge who described him as a flight risk set bail at 100,000 Singapore dollars (71,000 US). His passport was also impounded.

A worried-looking Fricker told the judge he needed a lawyer and asked that bail be lowered to 40,000 dollars.

But the judge cut him short and rejected the bail request, stressing the seriousness of the offence.

 

The official charge sheet said Fricker, who was arrested on May 25, was with a Briton identified as Lloyd Dane Alexander when he broke into the suburban depot, a restricted zone surrounded by fences topped with barbed wire.

Sources familiar with the case told AFP that Alexander was in Singapore on a tourist visa and left before a police report was filed.

The charge sheet said Fricker and Alexander vandalised public property when they cut through a fence and spray-painted two carriages.

A police spokesman described Fricker as a company consultant but further details on him were not available from Singapore officials or Swiss diplomats.

A man named Oliver Fricker is listed in the business networking website Xing as a senior consultant in Singapore working with a Zurich-based information technology firm specialising in the financial sector.

Vandalism is punishable by up to three years’ jail or a maximum fine of 2,000 Singapore dollars, plus three to eight strokes of a wooden cane, a punishment dating from British colonial rule.

An American teenager, Michael Fay, garnered global headlines in 1994 when he was jailed and caned in Singapore after he was found guilty of vandalising several cars. Fay was caned despite a US appeal for clemency.

Prosecutors in the train vandalism case, arguing for the high bail amount, said Fricker had been due to leave for Switzerland two days after his arrest.

The break-in, believed to have taken place before dawn on May 17, was not immediately detected and the train plied its route in full view of commuters, one of whom filmed it and posted a clip on video-sharing site Youtube. – AFP

    sg is a very small small place. Expectation by 1st world people is that SECURITY Lapses should not have repeated since the escape of a limper.

    a small place should be well managed and secured.

    the train is a sensitive public utility. It is used everyday and tens if not hundreds of thousand passengers like many readers or their friends and loved ones may be taking everyday. Everyday means, if disater strike at that time, chances are high that many could become victims.

    What i mean is if this were not just a grafitti issue, it could have been worse. Consider this as a litmus test for the bad guys observing sg. They now know there is VULNERability.

    This is just 1 of the many public utilities, if you will.

    This is a Public Interest issue. Many people are stakeholders of public thingies like the train, bus, airport, sea-transports etc.

    If there is lapse in SMRT, what else could also be Vulnerable but not yet discovered?

    Should we always react based on hindsight?
    Given the Mas selamat BOO BOO, what lessons were learnt?

    netizens have also reminded people the vulnerabilities of the Train system :

    1. passengers fainting/falling onto TRACKs getting dismembered. have we forgotten the public outcry for video cameras? Were they implemented in all stations already?

    2. LUGGAGEs that can contain poisonous materials or explosions. No need be creative to know this. It happened overseas already.

    We expect no MEDIOCRE or is it not?

    no doubt the graffiti is nice, but a nice piece of work is one thing, the govt never appreciates any singaporean to come up with nice piece of work and yet did not go by their ruling. i heard that if u want to paint graffiti at that youthscape, u have to submit a draft for approval before you can do so. so this swiss guy trespressed a secured area, damaged the fence, vandalised public property and did the graffiti in an unapproved area and he did not submit his draft.

    this govt will not get our respect if this guy is let off lightly since we will be penalised for doing the same thing.

    The act of vandalism by this Swiss Talent has shown up some shocking details about the way that Singapore Inc is run.

    FIRSTLY, it is now clear that all the talk about Government PRIVATISING state owned companies – is nothing more then sham talk.

    PRIVATISING is merely to place another layer that insulate the government from raising prices by laying the blame on these PRIVATE companies needing additional raise in prices to cover cost.

    The sham is that all these supposedly “Private Companies” are the various statutory boars or public service departments that were re-organised or shut – to be replaced by new Private Companies whose capitalisation comes from the Ministery of Finance.

    The personnel that run these new “Private Companies” were the same staff who were previously public or civil servants on government payroll – some were given retrenchment benefits and re-employed by these new “Government Owned” but “Privatised Companies”.

    SECONDLY, considering that there was a recent report that the Indonesian Police killed some terrorists in Java, and discovered planning materials that had targetted Orchard MRT Station – it is a surprise that there was no evaluation made to harden the soft targets that exist in the MRT System.

    Does the Home Team need another incident on the scale of the Mas Selamat escape before tightening up security ?

    THIRDLY, repeatedly drumming the message of public alertness to dangers of terrorism is useless when the authorities themselves are not showing any seriousness except for the various superficial display of heightened security that consist of police and SAF personnel making more frequent foot patrols to be seen by the public.

    Are those on foot patrol trained to note body-language or perhaps even to make preliminary “profiling” of individuals ?

    Minister of Home Affairs Wong Kan Seng must explain the ineffectiveness of his ministry’s Public Transport Security Command (TransCom) in discovering the breach of security manifested by the act of vandalism on an MRT train and acting on it swiftly as soon as it happened.     SMRT on the trains asks us to be mindful of suspicious characters and items but we could all be vigilant till the cows come home and yet someone could or rather can break into the depot and place a bomb right under the train.     Why didnt he practice his art & display his infiltration skills in his home country? If his own Govt support him, then their Embassy, Embassy’s vehicles will be throwing an open invitation to one & all to have MURALs sprayed all over Swiss properties here & abroad. Fair? Yes, very fair.

    No matter how tight security is, there is always a potential window for compromise – especially from deliberate, determined demons. Think September 11.

    in fact i think our security systems need to be constantly tested – starting from schools, condos, shopping centres, to train stations and airports. for e.g. it is easy to enter a condo just by riding a taxi and going through the gates without being asked much, should those security guards be sacked? and on mrts, how do we know if inflammables are contained in bags if they are not scanned? plenty of questions we have to ask.

    I don’t think the Swiss should be punished severely. Perhaps a fine for destruction of public property, but even so, the art is not offensive and in fact, IMHO, made the train look less sterile and boring. The graffiti is more aesthetically appealing than the asinine adverts they paste all over the trains.

    Caning is a bit too much for vandalism. It’s not like he smuggled drugs or committed murder.

    It’s not really about ang moh, or arrogance. The fact is without these two drawing on the trains we had no clue about the lax security in place to safeguard the trains. Vandalism is bad because it can be ugly and costs a lot to remove. But, in this case, the cost is compared to not discovering the security situation. Seems like more good has been done than bad.

BTW, Michael Fay was never caught “vandalizing” cars. According to the Penal Code the crime for vandalism refers to public property, and Michael Fay only crime that placed him as a vandal was that he removed a street sign which was a public property, for display in his room. His actions to destroy private properties, a.k.a. private vehicles were considered as mischief in the Singapore law. So for removing a street sign poor Mike got 4 strokes, this Swiss should get more strokes according to the Singapore Penal Code system.

    在新加坡,胆敢破坏围篱,伙同友人执行破坏行为,真是胆大包天。
    金融方面专业的资深商业顾问竟然作出此等事,而且是似乎是预谋的行为,其目的和动机然道就是想用苦肉计赚大钱?!
    在新加坡接受法律制裁(鞭刑或牢刑或罚款或三者兼施)之后,回到西方国家,媒体等采访的通告肯定接不完了,又可出书尽量诋毁新加坡政府怎样没有人权等。一旦畅销,钞票就滚滚而来了。真不愧是金融专家商业顾问啊!三国的黄盖都要给你给盖过去了。
    但是,鞭屁股不是好玩的。肯定让Fricker一生难忘的。如意算盘打得太快了。
    不过,可能Fricker先生 未必是存有恶意的。只是一时兴起而已。跟朋友两人喝醉了酒,相互激来激去,然后一时进魔,做出了如此的无心之失。因为,假如他们想要进行恐怖行为的话,后果就更不堪设想了。所以,我才说,这笔帐政府跟相关捷运公司首长会另外算的。
    现在Fricker先生或许可以效仿牧师们的做法,请求公司老板陪同拜访捷运公司负责人,然后说声对不起,以后不会再犯同样的过错,然后捷运公司负责人要很有风度的说,我们谈了两个小时的话,很融洽,我完全原谅他了。试试看。或许有效的。因为,好几个牧师都没有一个受到法律制裁的。
    谁能无错,知错能改,善莫大焉!新加坡政府也许会说他已经受到了社会的制裁了,而且已经知道悔改,也道了歉,而且也只是破坏公物而已。比起牧师们一而再再而三伤害了无数其他宗教自尊心的过错,简直小巫见大巫。牧师们累次的信仰精神伤害尚且能以道歉了事,当然Fricker先生也可以如法炮制了。可惜,法律的裁量权在法官的手里。但是,也可以问问律师,是否可以由律师陪同作同牧师们一样的道歉了事吗?问问无妨嘛。

    I’m okay with the jail term for Oliver Fricker.But what really hacks me off is that he got caning.It’s so outrageous because when a man kills an animal, he doesn’t get caned but when he vandalises an MRT train he does.Furthermore this Fricker guy is a foreigner,so I hope the Michael Fay saga will not be repeated 16 years later(now).
