Author of anti-death penalty book arrested

once-a-jolly-hangmanThe author of ‘Once A Jolly Hangman: Singapore Justice in the Dock’ Mr Shadrake, 75, has been arrested this morning, only a day after the book launched in Singapore at the Post Museum.

The British investigative journalist is being investigated by the police for alleged criminal defamation following a complaint by Media Development Authority and has also been served with a contempt of court order by the Attorney-General Chambers.

The book delves into and exposes the lesser-known aspects of Singapore’s criminal justice system. It also focuses on death penalty cases in Singapore – and gives readers a more intimate look into some of the high profile cases, especially those of recent years.

Spanning three years of work by the author and journalist, the book includes information from his 2005 interview with Singapore’s hangman, Darshan Singh. That interview was published in Australian newspapers and caused an outrage around the world, in particular Australia at that time. That was when the case of Australian-Vietnamese Nguyen Van Tuong was in the headlines. Van Tuong had been sentenced to hang in S’pore for trafficking drugs into the country.

dsThe book, with its meticulous research by Shadrake, includes rare interviews with Central Narcotics Bureau officers, lawyers, activists, and information gleaned from archives, court documents and news reports. It pieces together each of the story by filling in the blanks which are left out by news reports and throws up serious questions about Singapore’s criminal justice system itself.

It was released for sale in Kuala Lumpur on June 26 and went on sale at the Kinokuniya bookshop’s flagship store at Ngee Ann City around the same time, but was taken off the shelves less than two weeks later, purportedly under pressure from Media Development Authority.

The government has shown little tolerance in the past for those who cast doubt on the independence and fairness of the judiciary.

    This is a wake-up, eye-opener, clear-cut evidence of the intolerance of the authoritarian PAP government. Any criticism of Singapore’s judiciary cannot be accepted, tolerated, or refuted. The judiciary is squeaky clean, void of corruption, beyond criticism and can do not wrong. Who are the judges? God or saints? Aren’t they human? I have never come across any claim that humans are infallible. Humans have failings, make mistakes, are tempted and favour their own kind or protect their own skin or feather. Such acts are mostly committed surreptitiously.

    The government is obviously abusing its authority. How can there be contempt of court when one is not in court? Outside of the court-room, one is free to say what he likes, untruth, and truth, criticise, comment, evaluate, curse, opine, and so forth. LKY did that too and many people in other countries were outraged by his remarks. They should have arrested him for criticising their systems or policies. Didn’t LKY talked about corruption in other countries (and that must include their judiciaries)?

    Does everyone honestly believe everything LKY said or wrote is entirely and spiritually true? If so, why do people refute what he wrote in his memoirs?
    So here is an author who didn’t say very kind thing about Singapore’s judiciary. If there really isn’t a speck of truth, why bother to arrest him?
    I don’t see the arrest of the author as an act to protect the integrity of the judiciary or to prevent the erosion of the respect and trust in the judiciary. On the contrary, if the judiciary is beyond criticism then it will mean it has a free hand to do the unmentionables. Who is to say that Singapore’s judiciary is absolutely incorrigible and cannot go the way like many others? What is so special or divine about Singapore courts and the judges? I understand that the integrity of Singapore’s ministers and civil servants are maintained by high salaries. Isn’t this the same as buying or paying for something?

    Opposition parties never given airtime on tv/radio

    When it comes to pres freedom, even Malaysia is ranked higher than Singapore (not by much though, but the difference on the ground is quite evident)

    Why should the government be sensitive to anyone casting doubt on the independence of the judiciary, when its previous Attorney-General had spoken in open court that the Appeal Process is decidedly in the hands of the Cabinet, even when the Constitution clearly give the President the powers of clemency ?

    If a government can usurp the powers of the President, will it now also usurp the power of the judiciary either through legislating laws that tie the hands of the judiciary, or through select appointees to the bench ?

    The author of the book was not arrested for the writing but seems to have touched a raw nerve in one of the many cases cited in the book, which clearly exposed a possible case in the miscarriage of justice that resulted in an illegal hanging of an innocent.   • The Vignes Mourthi case?

    One possible contender is his characterization of the trial and execution of Vignes Mourthi as “arguably one of the most appalling miscarriages of justice in Singapore’s history”.

    Vignes Mourthi was arrested on 20 September 2001 and convicted of trafficking 27.65 grams of heroin.

    Mourthi’s conviction rested largely on the strength of evidence of the officer who arrested him, Sgt S Rajkumar, a senior officer of the Central Narcotics Bureau. Sgt Rajkumar was a key witness in the prosecution’s case, and Mourthi’s defense was that an incriminating piece of evidence collected by Rajkumar had been added at a much later date.

    Shadrake reveals that just three days after Mourthi’s arrest, on 23 September 2001, Sgt. Rajkumar was himself arrested for allegedly handcuffing, raping and sodomizing a young woman and for subsequently bribing her to keep silent.

    In the judgment convicting Rajkumar of bribery, Judge Sia Ai Kor described his actions as “so obviously corrupt by the ordinary and objective standard that he must know his conduct is corrupt”.

    Shadrake points out how the ongoing case against Rajkumar was never revealed to Mourthi’s defense lawyer, and surmises that the prosecutor and other parties must have known about Rajkumar’s case but chose to keep silent.

    In his book, Shadrake characterizes Mourthi’s case as groundbreaking enough to resemble the “catastrophic failures of the justice system in Britain” that contributed to the death penalty being abolished there.

    If Shadrake is right, then the authorities could very well be stepping up to the criminal defamation plate to contest his version of events.

    Actually this is the wrong move. Now I’m curious and will be hunting for this book to read and see why such strong reaction :) Forbidden fruit is sweetest.

    Although I support many of the Singapore govt policies, I think it shouldn’t resort to arresting people for expressing opinion unless if it incites violence, racial unrest or national security . If the govt thinks that what Shadrake had written was untrue, just issue a press release to clarify.

    We must see what happens after the elections. If there are no changes, it is time for the people to act. We have seen in Malaysia, Philippines and Indonesia how effective is people power in bring down despots and dictators.

    Maybe we have to start with boycotts and civil disobedience.

    Let us be resolute – vote the PAP out or at least send them a signal that the people are serious in wanting them out of office.

Kiasi Singaporeans will never do that – they are already held hostage – CPF money, HDB flat, high-ranking military and police officers, senior civil servants, CEOs, chairmen of 20 companies plus foreign talents who are ever-ready and willing to take the place of Singaporeans.
    Why do these kiasu Singaporeans want to lose their 6-figure salaries, comfortable condos, lexus cars, CPF monies for the sake of justice, fairness, equality, freedom of the press, freedom of speech and ideology?
    Why would they bother about hanging a young drug trafficker and arresting an angmoh writer?

    When it comes to civil disobedience no one dares to participate. Most Singaporeans will NEVER GO AWOL! They won’t even dare to stop their SP Services bill payment for fear of having their utilities cut. So don’t even talk about civil disobedience.

    We should assess the facts and not jump into conclusion. Certainly commenting on Court Judgements will whip up emotions. If defendants are unhappy with the outcome of their trials, there are legal recourses for them to address their dissatisfaction.

    In Singapore, what “legal recourses” are you suggeting for anyone to depend on and seek help “to address their dissatisfaction” ?

    Have you read the book – “The Fajar Generation” that was co-authored by Dr Lim Hock Siew and his other detainees locked up during the 1960s in Operation Cold Store ?

    You should read the outcome of petty punishment being applied to him and his fellow detainees for appealing to the good services of a supposedly independent committee to review the detainee’s imprisonment.

    With Singapore firmly gripped by the Old Man – who is determined to dominate the local political scene – by manipulating the electoral process that allow for his total dominance of Parliament, so as to freely pass legislations that tie up the citizens and the hands of the judiciary – through mandatory laws proscribed by Parliament; and to be in a position to vet nominees to the position of the Elected President, as well as members of the judiciary bench; PLUS usurping the power and rights of the President to review and grant clemency to anyone convicted of any arbitrary laws – what legal recourse do you think you can have to address your dissatisfaction ?

    Mr Shadrake had written was about the possibility of a death sentence being based on the possibility of tainted evidence by a cop who was proven to be dishonest, but whose dishonest conduct was never revealed to benefit the defense of the accused given the death sentence.

    This is not the first time that the Judiciary had failed in seeing justice being carried out.

    One should consider the trial of Tan Wah Piow – the President of the University of Singapore Union.

    Tan was accused and charged for rioting inside the premises of the Pioneer Industries Employee’s Union, and the judge was at his best in being difficult towards Tan, dismissing Tan’s evidence that it was not possible for him to be rioting and damaging the union’s property, which Tan had claimed was the evil work of the Secretary General of the Union so as to fix Tan for interfering with the union’s work in representing the industrial workers who were on strike.

    The Secretary General of the PIEU was none other then Phey Yew Kok – who was a Member of Parliament and seen as a rising star in the Pro Alien Party; and who subsequently absconded from Singapore on corruption charges when constructing the Big Splash at the East Coast [now partially demolished]

    At least, Tan was not sentenced to death, but was eventually jailed, and upon release was immediately conscripted and assigned to the Artillery that was then required to go on route march with the 120mm motar dismantled and man-packed.

    This is justice for the ordinary citizens on a Little Red Dot controlled by the Pro Alien Party.

    The “multitude of us” – that go about daily to “protecting our families” – are the ones that happened to be out of sight and are the insignificant digits in the eyes of the Pro Alien Party.

    Wait till you happen to fall foul to the arrogance of the Pro Alien Party and have to claim back your lost rights and space – then no one will be helping you as you attempt to climb out of the hole that you have allowed to be dug under your feet.

    When the Attorney-General of Singapore can openly state that the Cabinet decide on any appeal to the President, and will then advise the President to act accordingly, the powers of the President to grant clemency has already been usurped by the Political Party that form the Government Cabinet.

    While the Judiciary is seemingly independent, the appointments to the Judiciary are vetted by the Politicians taking the positions of the Executive Cabinet, and the hands of the Judiciary are tied by the mandatory laws that are passed by a Parliament that is dominated by a SINGLE Political Party.

    With the SINGLE Political Party dominating in all the supposedly independent roles of Governmenance – that are separated into the Executive, the Parliament, the President and the Judiciary – do you expect yourself any space for independent opinions to judge your position in any situation that you are unwittingly caught in ?

    You are a mere digit and a product of the social engineering process deliberately designed by the domineering Political Party in power, and you are held to ransom and to their mercy – as well as to their patronage.

    Keep your nose clean and pray that along the way, you do not fall foul with their laws.

    Is there any parallel relevance in the failures of USA financial system with the present state of justice in Singapore ?

    In the USA, there exist the clear separation of power – where the citizens can depend on the INDEPENDENCE of the JUDICIARY to check any abuses of the Executive Government and the Congress to the Constitution; meanwhile, the Senate and Congress can also impeach the President or any one of the Supreme Court justices for any failures in executing their duties.

    Does such a system exist in Singapore – where the Cabinet is accountable to any independent enquiry to the loss of US$100 BILLION from the National Reserves ?

    Is there any justice when the Pro Alien Party will hold the Alternative Political Parties to be responsible for the book keeping of their political contributions, while they will not submit themselves to any accounting for their role in losing the US$100 BILLION by GIC and Temasek Holdings ?

    Dinesh Bhatia
    One of those accused was Dinesh Bhatia, the son of former judicial commissioner Amarjeet Singh. Bhatia faced 10 years behind bars for consumption.

    Shanmugam
    His defense lawyer, K. Shanmugam (now the Minister for Law) stated at trial that Bhatia did not know it was cocaine that he was snorting. In the end, after appeal, Bhatia’s sentence was reduced to eight months, but less than three months after that, he was reported by the Straits Times to be at home, albeit wearing an electronic tag.

    The drug supplier to Bhatia and the others was Ben Laroussi, himself a high-ranking executive. Laroussi was arrested on the capital charge of trafficking, but when the drugs were tested a second time, the quantity he diminished miraculously below the mandatory hanging threshold.

    This tactic of “short weighing” is frequently used by the Singapore police to save the favored few from the hangman’s noose.

    Laroussi was given bail on his own recognition, upon which he disappeared from Singapore.
