Participant of “I Hate YOG” Facebook arrested by Police
A participant of the popular “I hate YOG” Facebook” Mr Abdul Malik Muhammad Ghazali was arrested by the police yesterday for a comment he posted on Facebook.
Malek wrote on Facebook that he was questioned by the police from Bedok Police Division on the charge of “inciting violence and public disorder” under Section 267 Chapter 244 of the penal code. His laptop was also seized.

The news was reported in page four of The New Paper today.
In an email reply to Temasek Review, Mr Malik said he was arrested over a particular comment he left on the Facebook and was questioned over his involvement with the “I hate YOG” Facebook and his political affiliations:
“The official reason given was the particular comment, but they did question about my involvment in the Facebook group as well. Such as, why did I start a Facebook page, what was my problem with the YOG, did I join any political party, etc.
Fixating on the specific words is, in my opinion, very shallow of them as they are not reading with understanding, although the meaning is quite clear.
On a side note, the reporter did mention to me this morning that the police are uncomfortable with the media inquiries about this case. They do not want to be seen as “heavy-handed”. This is because the charge is very subjective and the police do not wish to look bad in the light of the criticisms of the YOG.”
According to The New Paper article, Mr Malik posted a comment written in capital letters saying that the incident showed it was time to “burn” the minister.
In the same posting, he also called on the public to “rally together”.

Mr Malik had earlier posed several difficult questions about the YOG to PAP MP and Young PAP Vice Chairman Mr Zaqy Mohamad on his Facebook which he was unable to answer such as the recent mass food poisoning outbreak involving 21 YOG volunteers:

Mr Zaqy subsequently removed Mr Malik as a friend from his Facebook.
Started only two weeks ago, the Facebook has garnered more than 2,700 friends so far.
The founder of the Facebook Mr Edmund Khor just clarified that he has not been called up for questioning by the police yet.

I know and can see that the Malay community in Singapore is going through a tough time. So many things have changed for them, they are fighting for survival. Not them alone, most local Singaporens are.

Abdul Malek is really unfortunate. The purpose of arresting him has nothing much to do with his dislike for YOG. It is done to show the people living here that there is a price to be paid for free speech.
The authorities are afraid that people will get more VOCAL if this “I hate YOG” facebook page setup is allow to pass without any incident.
If people are allow to get more VOCAL, they will post their opinions on more issues which may threaten the present party’s rule.

I don’t think Singapore is ready for organizing such an event when internally in Singapore, there are so many problems plaguing Singaporeans. We may be a first world country on per capita GDP basis but, let’s ask ourselves, do we all feel like living in a first world country? Is our quality of life 1st world? Do you fear that if you lose your current job now, you may not be able to get a better one next time? Did you have such fear, say, 10 years ago?

The full story is published in this morning’s New Paper. I already expected something like this is bound to happen. The poor guy is simply made a scapegoat of the circumstances. This is NOT a democratic society after all. Instead of putting rightful public explanations to justify their actions, the ‘top management’ simply keep quiet and let their ‘cronies’ do their dirty work.

Ok ok… For those who are still in disbelief whether this article is true or not, let me state: It is TRUE.
What happened (the facts – opinions aside) is true. Since the police already have my internet nickname, I might as well reveal it.
I was the joker who got to drink kopi at the Bedok Police Station with GIS-04. Yes, I am that guy Abdul Malik.
To their credit, if you co-operate with the police, they won’t treat you badly. I was treated okay by them, and they were kind enough to spare me the humiliation of being handcuffed at my workplace. I really have to thank them for that.
I won’t place the blame on them. They are acting on orders and they are pretty professional about it. I have been in a similar position to theirs, so I understand what they are going through.
Nonetheless, I still state that I have done nothing wrong. It is entirely subjective (the charge, that is) and if it rubbed anyone the wrong way then it’s not my fault. It wasn’t meant to defame anyone personally. It is my own critical opinion of the YOG and the SYGOC (and related persons).
How is this construed as “inciting violence and public disorder” is really beyond me, and I have re-iterated that to the police. I maintain that (to me), I am NOT GUILTY.
This is one of those laws that have a very broad and subjective interpretation. Not as if it’s CBT, which is pretty clear cut. The lines are blurred here. I don’t envy the IO’s job, which must be tough with pressure from “upstairs”.
I’m just waiting and seeing what happens next.

Of course the PAPies are scared because one of their own dogs, MP Ong Seng Heng, got burned by a Singaporean. TO us it may be trivial but the PAP ministers are really afraid of being hurt by the public. Of course, if they were real politicians out to help the people then they wouldn’t be so afraid but they seem only interested in other matters such as ensuring that FTs are well taken care off.
Don’t be afraid to speak your mind but be mindful of what you post especially words or phrases or sentences that may seem to incite violence towards a paranoid group of people.

How does a citizen’s political affiliation come into the scope of the investigation? Is the police responsible for eradicating citizens’ existence for holding a political view other than that of the ruling party? NOT ENTIRELY TRUE: For a case of this nature to be “actionable”, the act of sending a “signal/message” is insufficient ground for a prosecution.
If you send a letter threatening to burn a Millister, the letter has to be received by the intended recipient to establish “incitement”. If your letter is lost in mail and or not delivered due to any reason, then the incitement part cannot stand.
So even if someone send an email to TR inciting violance or whatever, the authorities have to prove that TR had actually received that email (thus the need for TR’s server logs to concur) to constitute an offence. The mere act of sending the email without proving receipt is very very lame ground for prosecution, unless we are talking about PERSECUTION which then we can all BURN (oops, the sacred word) every law books in Sinkapore.

That said, note that VPN software including the tunnel encryption that can be used in Singapore needs import approval (at least officially)….. In other words, the powers-that-be here have the tools to peep into VPN tunnels if they so desire. However, it’s unlikely that the ISPs have the tools on a mass-scale to be able to do this.

There is no immunity from Police arrest and prosecution. So long you are honest and speak the truth there is nothing to fear. If you make an allegation against any person, you must be able to substatiate it with evidence. The laws in Singapore ensure you are responsible in what you say. In other words, the person who alleges is the person to substantiate it with evidence; otherwise you face the full brunt of the law.

On a serious note, you can be displeased all you want. Just don’t be stupid enough to get used as the scapegoat. It’s the same as illegal downloading. Every single singapore citizen has downloaded movies and music. Even by visiting someone’s blog with a song attached/embedded, your browser has to download the song for you to hear it. which is illegal. See, we’re all criminals. But only a few get selected for piracy charges arrest, to serve as an example.
