Minister George Yeo on S-League Brawl: SPF is not afraid to touch foreigners

Minister for Foreign Affairs George Yeo has replied on his Facebook that the Singapore police will act impartially in the S-League brawl involving PRC and Singapore players. He has assured all Singaporeans that the SPF is not “afraid to touch foreigners” if they have committed criminal offences in Singapore.
Replying to queries by Netizens over the recent S-League brawl between GUOAN Football Club from China and Singapore Young Lions, he said:
“…..I don’t think SPF (Singapore Police Force) is at all afraid to ‘touch foreigners’ if they have committed criminal offences.”
Excerpts of his Facebook Q&A reproduced verbatim below:
Kojak Bt: Perhaps the minister can explain. If Singaporean Abdul Malik was arrested for “inciting violence and public disorder” by using the word “burn” on his facebook, shouldn’t these PRC players be arrested immediately for assault already? What is the Singapore police doing? Dare to arrest Singaporeans but dare not touch foreigners?
Tony Tan: Minister Sir, I hope that our govt stop practice double standard. It obvious the above match fall under the category of inciting violence. To make it fair, SPF should investigate both parties including Singaporean players involved.
George Yeo: Double standards? I don’t think SPF is at all afraid to ‘touch foreigners’ if they have committed criminal offences.
For the benefit of readers out there who may not have noticed, the catch phrase is “if they have committed criminal offences“, thus IF the incident is seen as or classified as “sports injury” (which is very lame) or “Voluntary Causing Hurt” (VCH is not a seizable offence but appropriate in this case), then the players would not have “committed (seizable) criminal offences” and no further action would be or can be taken by the police.
For police to take action against a person for Voluntary Causing Hurt, a Magistrate Complaint has to be filed in a Magistrate’s Court which would then empower the police to investigate and take further action, if necessary.
Additionally, the complaint has to be filed by a concerned party, ie: the victim himself, the parents or guardian of the victim, a lawyer acting on their behalf or the FAS (who has indicated that they will not get the police involved) and only an “internal investigation” will be carried out.
Although Young Lions’ midfielders Gabriel Quak and Faritz Abdul Hameed were sent to the hospital for treatment, unless (touch wood) either or both of them have a broken skull, fractured ribs or disfiguration on their faces or head qualifying of ”Grevious Hurt” under the Penal Code, Singaporeans can expect no further action from the police in this fiasco.
Definition of Grievous hurt under the Penal Code
320. The following kinds of hurt only are designated as “grievous”:
(a) emasculation; (aa) death;
(b) permanent privation of the sight of either eye;
(c) permanent privation of the hearing of either ear;
(d) privation of any member or joint;
(e) destruction or permanent impairing of the powers of any member or joint;
(f) permanent disfiguration of the head or face;
(g) fracture or dislocation of a bone;
(h) any hurt which endangers life, or which causes the sufferer to be, during the space of 20 days, in severe bodily pain, or unable to follow his ordinary pursuits;
(i) penetration of the vagina or anus, as the case may be, of a person without that person’s consent, which causes severe bodily pain.
The best case scenario Singaporeans can ever hope for in this fiasco would be upon the completion of the FAS’s “internal investigation”, the offending players from GUOAN Football Club be “sent home” while offending local players get the blame for the brawl and taken to task.

@Lau BakKwa, not entirely correct. the police have jurisdiction over all PUBLIC places and PRIVATE places (by way of warrant and certain provisions) and the foorball stadium is a PUBLIC PLACE by definition.
What this articles discusses is the NATURE OF THE OFFENCE which is non-seizable thus the Police CANNOT take further action without an order from a Magistrate.
The offence in me this article is only a guess which me finds most appropriate for explaining WHY the police is not getting involved, in accordance with the Law.
But then hor, me have also inadvertedly provided the police with a good excuse for them to not get involved without them having to convene an internal meeting to churn out lame wayangs.

I recall SPF used “rioting” charge and successfully convicted a group of teenagers when two different racial groups fought over rights to use basket-ball court in a HDB estate.
The same was applied to a group of school girls of “gang activities” charge were made when they attacked and forced their victim to perform indecent acts on stairway landings.
Nothing unusual about the use of “catch-all” clause in the Penal code to hang criminal activities.

Here is some law definition of “grievous bodily harm” defined as “”any bodily injury of such a nature as to endanger, or be likely to endanger life, or to cause, or be likely to cause, permanent injury to health.”
“Bodily harm” may not be defined in statutory law but it is wide enough to even include any diseases which fall into any of the following outcome in Australian law
a reference to causing or doing grievous bodily harm to a person includes a reference to causing a person to have a serious disease.”
9 Section 1(1) was amended to add a definition of the term “serious disease” to mean:

Agreed. If ACS student was charged in court for punching another, then this case does not proceed into the courtroom, Singaporeans are entitled to believe it is cover-up by officialdom. This one is far more dangerous and potentially dangerous of life-threatening consequences of kicking someone’s “medulla oblongata” (back of the head) and the appropriate charge should be “grievous hurt”.
