High Court accepts Dr Tan’s application challenging reserved Presidential Election

COURT APPLICATION ACCEPTED

I would like to announce that this morning, the High Court accepted my application (HC/OS 495/2017), which seeks the Court’s determination on whether a piece of legislation (section 22 Presidential Elections (Amendment) Act 6 of 2017 which counted President Wee Kim Wee as the first Elected Presidency term for the purposes of calling a Reserved Election), is consistent with our Constitution (Articles 19B(1) and 164(1) which introduced the mechanism of a Reserved Election into our Constitution).

I am the Plaintiff and for the purposes of serving Court papers on the Government, the Defendant is the Attorney General.

The application was filed on 5 May 2017. The Court accepted my application this morning, and has fixed a pre-trial conference on 22 May 2017.

To recap, on 31 March 2017, I held a press conference explaining why in my layman’s opinion, starting the count from President Wee’s term appeared to be inconsistent with the spirit and purpose for reserved elections. I then invited the Government or AG to explain the legal reasons for their count.

On 1 April 2017 the Government through MCI said I raised no new points that require a response. I responded to say the MCI missed my point. Nothing further was heard on this issue.

Since this is a matter of national importance, I sought to find the legal answer and consulted the best constitutional lawyer I could find. He is Queen’s Counsel Lord David Pannick. I gave Lord Pannick the Commission Report, White Paper, all relevant Hansard parliamentary reports from 7 Nov 2016 to 6 February 2017, our Constitution and all related statutes on this issue. I asked him one question: whether the AG correctly advised the Government to specify President Wee’s term as the first to be counted on the basis that he was the first President to exercise elected powers.

Lord Pannick has advised that he disagrees with the AG’s advice, and that section 22 Presidential Elections (Amendment) Act 6 of 2017 as it stands is unconstitutional. After receiving Lord Pannick’s reply, I felt I could not keep his legal opinion to myself. It would be in public interest to have the Court decide which legal view is correct – Lord Pannick or the AG.

On 28 April 2017, I engaged M/s Tan, Rajah & Cheah to make the necessary application, and to produce in my affidavit Lord Pannick’s written opinion before the Court. I believe this question can be answered without confrontation or hostility. Both the Government and I have the nation’s best interest at heart. It is in nobody’s interest to have a Reserved Election that is unconstitutional.

I am satisfied that I have, to the best of my ability and capacity, done my part to do what is right in the circumstances, which is to bring to this Court’s attention Lord Pannick’s opinion. Since the matter is now before the Court, it is only right that I refrain from making any further public comment until this case is decided.

Who is Lord Pannick

The Right Honourable Lord Pannick is one of UK’s most highly regarded Queen’s Counsel, who specialises in Public law & Human Rights. He is also an independent member of British House of Lords. In the House of Lords, he was a member of the Constitution Committee for four years.

Recognised as one of the “stars at the bar” for his handling of high-level cases in UK and international law, Lord Pannick appeared in some 100 cases in the Appellate Committee of the House of Lords (before it was replaced by UK’s new Supreme Court). He has argued more than 25 cases in the European Court of Justice in Luxembourg and over 30 cases in the European Court of Human Rights in Strasbourg. His long list of appearances before the highest appellate courts in the UK and Europe is almost second to none.Graduated from Oxford, Lord Pannick was ranked as one of Chambers UK’s Top Silk Bar 100 in 2013. The Chambers UK, a British legal guide said of him, “Without question, he’s superb. He’s a man of great intellect who can turn his hand to almost anything.”

The Times Law 100 also listed him as one of the most influential lawyers in UK and ranked him in 10th place. A judge said, “Lord Pannick is one of the country’s most powerful advocates.”

Some of his notable clients include:

  • The Queen – winning an injunction in the High Court to restrain The Daily Mirror from publishing further allegations about her home life by a reporter who had gained employment as a footman.
  • * The Kingdom of Saudi Arabia – in establishing in the House of Lords that state immunity applies to claims alleging torture.
  • Princess Diana – advised on an employment tribunal case.
  • Greece govt – resisting the claim brought by former King Constantine for the return of property.
  • Cyprus govt – in relation to human rights abuses by Turkey in Northern Cyprus.
  • UK govt – in establishing that MPs accused of dishonestly claiming expenses were not entitled to the benefit of parliamentary privilege.
  • BBC – defending BBC that it had committed the criminal offence of blasphemy by broadcasting “Jerry Springer – The Opera” (following the judgment, Parliament decided to abolish the criminal offence of blasphemy in UK).

Last year, in the most famous case in UK, Lord Pannick successfully represented a citizen against the State to require the approval of Parliament before the Prime Minister could initiate “Brexit” from EU.Internationally, he has also appeared in a large number of cases in courts outside of UK: Hong Kong, Brunei, the Cayman Islands, Trinidad and Tobago, Bermuda, the British Virgin Islands and Gibraltar. In Hong Kong, he has appeared in some 15 cases in the Court of Final Appeal, many of them on major constitutional and public law issues.

He became an Honorary Fellow at Oxford in September 2004. He writes a fortnightly column on legal matters for UK’s Times, and is the co-author of “Human Rights Law and Practice”, an important textbook used by many universities on Human Rights Law.

It would certainly be interesting to read Lord Pannick’s legal view on why President Wee should not be counted as the first Elected President of Singapore and why section 22 of Presidential Elections (Amendment) Act is “unconstitutional”.

    “All” (including PAP) “have the best interest of the nation”? But, surely, it isn’t “in the best interest of the nation” to have to resort to that special provision of restricting the EP to only candidates of one race earlier than necessary. That arrangement can only be a second best, implying that our voters had somehow been racist and prejudiced, and cannot be relied upon to nominate and vote fairly based only on merit. Or, worse, it implies that Malays or some other “minority race” are indeed inferior to the Chinese, and cannot, without given the handicap, be left to compete. (Note that the latter is itself a racist viewpoint!)

    Now, this issue having been accepted by the Court means it is indeed arguable. Then why, if PAP had the best interest of Singapore at heart, did they not “argue” for our “best”, and therefore take Dr Tan’s view that we have not yet gone through five elected Presidents without having had a Malay President? Why bother to stretch the letter of the Constitution to enable Wee Kim Wee to constitute the first elected President, only to have this restricted PE and by it have Singapore concede that we are still racist or that our Malays are somehow inferior? Surely, the special, restricted PE has been meant to be only a last resort? Why resort to it before it is strictly Constitutionally due?

    If one AG had ruled that within 200m of the balloting centre is illegal, but inside the balloting area is legal, then another AG can easily rule that within the constitution Wee is not elected president, but outside the constitution Wee can be counted as elected president. Lest you forget, with 70% mandate they can suka suka change the consitution to suit their warped logic.

    All of Lord Pannick’s experience/exposure and list of honours will count for nowt in a Singapore court. He will not only be “humbled” but bumbled/brought down to earth/SGsoil.

    Many an esteemed QC have tried, not least the late but eminent QC George Carman, who taught GCT, then PM a thing or two about real “cross examination” when Carman said, Goh paid lip service to democratic freedoms of speech, press and opposition, but “there comes a point where you adopt them for your own purposes to stay in power and stifle opposition”. To which Goh replied, obviously without thought, “we are an unusual democracy and we run it our way”. Therein lies the affirmation about democracy in Singapore and despite a full face lift to flourishing metropolis, it has not move that much further from autocracy.

    Pardon my deviation but it only serves to highlight the issues that plague the SG judiciary, in that it has not harnessed the true essence and virtues of “the rule of law” and the neutrality and single mindedness required to discharge it.

    Following on shortly after Judge Cole’s written submission of SG’s political cum judiciary views, with the world and interested viewers watching/following, it would be fascinating to observe how the “legal mind/s” in this case will opine and deliberate ………. on behalf of Singapore.

    I would suggest that TRE should invite its readers to nominate a public figure (a non-Government man) at the end of each year for the man of the year title and honour him/her so in a public function with a validation recognising the person’s contribution in advancing important public issue concerns. The reader, participating, in the nomination, should spell out the reasons why he/she nominates the person.

    In my view, some of the figures in the running would be Dr Tan Cheng Bock, Dr Chee Soon Juan and Kenneth Jeyaretnam. TRE why not run it and test it out? They spend so much of their energy and bear financial costs behind the scene to fight for public interest causes and they deserve some public recognition.

    2. If he was offered to be a minister under LKY PM1, likely he nicely turned LKY down in reject of his megalomania allegiance demands in every which way. Most honourable again.

    3. So past tense old coot knew he could count on Dr. TCB to tap his ideas for his political fortunes to paved to way for his son to be PM3. Most able honourable Singaporean to date.

    4. Thus Dr. TCB stayed for as long as could till the last call by himself or otherwise. Don’t remember when and how he left PAP. but one thing us sure, he stood as a true Singapore and patriot with his eagle eye over PAP and fellow citizens voting mentalities. So that when he sees something untoward he can be relevant to neutrally point out by legal means too. So he does it now for all Singaporeans sake when applicable laws are conflicted by this PAP government. And so credibly, he points out the PM appointed AG’s legal error. and backed by a true true UK QC grounded in Hansard famous and beyond it also.

    Dr. Tan Cheng Bock is truly incredibly the best, capable, sincere and honourable plus righteous patriot Singaporeans can ever have/ Indeed Heaven sent indeed. If daft LKYism son tries to fight legitimate Heaven, he will meet his demise. After all, didn’t he publicly say that he is mortal after his second prostate operation. So fast he forgot?     Congratulations Dr. Tan, Well done!

    Your courage and tenacity, civic-mindedness, and concern for public interest, is admirable.

    As we know, JUSTICE IN SINGAPORE IS FOR THE POWERFUL AND THE RICH. Dr. Tan probably is not super rich like the PAP $Million Ministers. All his political career, he was only an MP; he never became a $M Minister or held $M directorships in GICs, coz he was the lone and PAP-loathed, PRINCIPLED VOICE in Parliament. Whatever wealth he has is from his profession as a hard-working doctor – and one who waives or charges a nominal fee for needy patients.

    However, though not super-rich like the millionaire/billionaire ministers, Dr Tan has the civic-mindedness and public interest at heart to take court action to challenge the Reserved Presidential ruling – galvanised of course by the cheated opportunity to run for PE2017, which he has a high chance of winning.

    In the circumstances, I think Dr. Tan (or a supporter) should start crowd-funding/direct donations campaign to help finance his noble action (which PAP may even try to sabotage by imposing exorbitant/deterrent fees and charges). In the event, COUNT ME IN.

    Let’s hope the High Court Justices know simple arithmetic. My four-year-old kid already know how to count from 1 to 100 in K1. But then, surprises are plenty nowadays in Singapore. The 2 clowns in the Appeal Court who gave the Kongman and his accomplices a massive discount off their jail terms, is a good example of what renegade justice is all about if they want to set the criminals free. Never mind, if the whole world is watching and laughing their head off.

    Reported in the ShitTimes and CNA 1 day ago – Toby Landau becomes first Queen’s Counsel to be admitted to the SG Bar. Mr. Landau, 49, will be based in SG and has met the pre-conditions for general admission to the Bar here, including residency requirements. Minister for Law had given Mr Landau the requisite exemption and the Law Society therefore took no objections to his admission.

    Diving deeper into the news, I discovered very interesting reading between the lines :
    1. The Law Society considers this one-off, sui generis admission as a boost to Singapore’s growing stature as a legal hub with world class lawyers,” the Society said.
    Sui Generis meaning : Law, when a special and unique interpretation of a case or authority is found to be necessary

    2. The judge noted while QCs have been admitted on an ad hoc basis to argue particular cases, Mr Landau has chosen to throw in his lot, so to speak, with us.
    Has the judge conveniently omitted the words “and also Speak FOR us”? Tony Landau’s QC fee of between $3000 – $5000 (estimated) PER HOUR are paid for by SG taxpayers.

    3. He will not be joining or establishing a full-service law firm in Singapore. He will work alongside other Singapore lawyers as part of his existing international practice.

    Looking at events that happened in the last month concerning EP and the ever-growing resentment from the public, PAPSmear with its network of informers/spies received inside news that Dr Tan would pursue the case all the way to the top for intelligent answers.
    First, to fog up the mirror, they made further changes to EP by having a commission check on the President. Next, they quickly admit a QC to the SG Bar ready to do battle with a prominent QC acting for Dr Tan.
    Law Minister Shamemugam and SG judges realise they are way out of their depths. The world is watching how much more smoke and mirrors PapSmear-Leaderless-Eunuch want to throw at their political rivals.
    Would Shamemugam have the balls to rebuke QC David Pannick, Dr Tan’s legal advisor that “he has seriously misconstrued and it is first useful to read and understand what has been said, before jumping in to comment. Otherwise David does no credit to himself as QC. Particularly when he is appointed by the Queen with the distinguished status.”
