Statement by DPM Teo Chee Hean on Ministerial Committee

Following the passing of Mr Lee Kuan Yew, PM Lee Hsien Loong had recused himself from all Government decisions to be taken on 38 Oxley Road. I chair Cabinet should any deliberations take place on this property.

I set up a Ministerial Committee to consider the options for 38 Oxley Road and the implications of these options. This was explained in the statement by the Cabinet Secretary of June 14, 2017.

There is nothing “secret” about this committee. It is a committee like numerous other committees that Cabinet may set up from time to time to consider specific issues.

I chair this particular committee, and included cabinet members responsible for heritage, land issues and urban planning, i.e. Minister for Culture, Community and Youth Grace Fu, Minister for Law K Shanmugam, and Minister for National Development Lawrence Wong.

The Government has the responsibility to consider the public interest aspects of any property with heritage and historical significance, and this applies to 38 Oxley Road.

Many critical decisions on the future of Singapore were made there by Mr Lee and our pioneer leaders. The Committee has thus been looking at the options available for 38 Oxley Road while paying particular attention to respecting Mr Lee Kuan Yew’s wishes for his house.

Mr Lee Hsien Yang now owns the property. As provided for in Mr Lee Kuan Yew’s will, Dr Lee Wei Ling can stay in it for as long as she wishes. The government has already stated on several occasions that it will not do anything to affect Dr Lee’s right to continue living at 38 Oxley Rd.

Some have asked why then a ministerial committee was established if no immediate decision was necessary? Due process is needed to consider the various options before making any decision on the house. This can take some time. I also considered several other factors.

First, if Dr Lee chooses to move out of the house in the near future, a decision on what to do about the house might have to be taken at that point.

Second, soon after Mr Lee’s passing, the Executors of Mr Lee Kuan Yew’s will (Mr Lee Hsien Yang and Dr Lee Wei Ling) themselves wanted the Government to commit itself immediately to demolishing the house, though Dr Lee Wei Ling might continue to live in the House for many more years.

Three, some of us in Cabinet, including me, felt it would be useful if a future Government deciding on the house had a set of options that came from ministers who had personally discussed this matter with Mr Lee Kuan Yew.

To get a clearer sense of Mr Lee’s thinking on the house, the ministerial committee wrote to all the siblings to ask them for their views. When the siblings provided us with differing accounts of their father’s wishes, we asked them for further clarifications. The committee’s interest in Mr Lee’s will is confined to the light that it sheds on his wishes for the house.

The Committee has tasked the relevant agencies to study a range of options for the property. I have shared some of these options with the siblings. For instance, they know that I would personally not support the options at either end of the range: at one end, preserving the House as it is for visitors to enter and see would be totally against the wishes of Mr and Mrs Lee Kuan Yew; and at the other, demolishing the house and putting the property on the market for new private residences.

The Committee has also been studying various intermediate options such as demolishing the House but keeping the basement dining room where many important historical meetings took place, with an appropriate heritage centre attached. These studies are ongoing.

    DPM TCH’s explanation for setting up a ministerial committee sounds rather disingenuous. It was an insidious attempt to preserve the House as a PAP holy site to brainwash all future voters to favour the PAP. Dr Lee and LHY smelled a rat and knew that their d**honourable brother would go against the Patriarch’s wish. The dispute has tremendous ramifications for the nation. LKY will not go to the happy hunting ground peacefully. He will put a curse on all the PAP MPs if they dare to defy him.

    Since 38 Oxley Road is a private property, is it a practice to set up a committee for every private property?

    According to the Will there is only one option, and one option only, why is there a need for the committee to decide. Should it be the rightful owner of the property to decide what to do with it?

    This committee was considered “secret” because this committee was only known to the owner recently. There was no prior announcement!!!

    Is this committee legal? Is it not infringing other’s privacy? How much this committee would cost to the tax payers?

    This is the first the general public heard of this Ministerial Committee and the composition of ministers in it.

    How come the public was kept in the dark about it until now? The general public has no Locus Standi to know or no right to Know.

    Why is this Ministerial Committee necessary to provide options for the House at 38 Oxley Rd. What options can this MC provide to the beneficiaries one of whom is their boss the PM without the other two claimants looking askance in such an incestuous arrangement when the PM is in direct conflict with the other two claimants.

    38 Oxley Rd is a private property owned by the will-maker. He wanted it demolished. The executors or the siblings have the legal right to sell it on the open property market or to any individual and the proceeds from the sale shared in any way agreeable to the three siblings. The PM cannot dictate his siblings to any charity if they are not happy to do so.

    This is the most absurd Ministerial Meeting ever convened. Look, there is a current economic crisis where 3.5 % of Singaporeans are without jobs and of which only 65% could find jobs only after 6 long months. Don’t the ministers think that they should convene urgent Ministerial meetings to solve this unemployment problem rather than wasting precious time and money (by the millions) discussing whether the basement of LKY house should be preserved for heritage purposes.

    Look, we have spent too much time mourning over the deaths of LKY and Nathan, celebrating the economically unproductive SG50, National Day and now NSF50. Can the senior Ministers sit down and do some serious work worthy of their astronomical salaries instead of delegating the work of the Economic Crisis Committee to junior Ministers while they debate on the fate of LKY’s house. Over the years, our neighbors are slowly but surely catching up on us and yet our ministers continue to indulge in frivolous activities.

    To quote Shanmugam’s use of the word “ridiculous”, I must say that it is ridiculous and unproductive to have senior ministers sitting in a Ministerial Committee debating over a house when there are clearly more important “bread and butter” issues to resolve. Do they care about the livelihood of Singaporeans or worry about some stupid heritage that the founding father couldn’t give a damn.

    To the ministers and the PM in particular, please sort out your priority or resign. Singaporeans deserve better Ministers for the salaries that they pay to you.

    Why take you sooooo long to come out to inform Singaporean that you are the Chair of the committee. Do you mean you need 3 days to ponder and think through if you are sitting on the correct chair. Also, the name list suddenly appear with the 4 ministers’ name. I smell rat here.
    To prove to Singapore that you are the real chair and not a chair that was hastily assemble together only during the last 24 hrs, pls publish the memorandum and the intent of forming the committee, meeting minutes, email communications .

    First of all,….were those buildings previously designated as “Heritage status”, ie Duxton , Alkaff Mansion, even Boat quay and clark quay heritage status….don’t tell me these “Heritage status” designated to these buildings were also being discussed in Parliament by a Special Committee ????

    If these lot of Heritage status building (which has significance to preserving our history were last conducted via Special Committee in Parliament…then there is nothing secret ,since ALL Have undergone same “treatment” and same “procedure”.

    However,…if these lot of designated Heritage buildings were not even “discussed” in Parliament or when thru same “Special committee”….then I am afraid…it would be “viewed” as “Bias” and “double standard”.

    If such thing have relly taken place…then, HY used of the word “abused of power and state organs” may seem to be a “fair” statement used .

    So,…we should “Compared” Apple to Apple in the same way and procedure which we had used to “designate Heritage status of Clark quay, Alkaf Mansion, Duxton…etc.

    Anything difference in procedure and yardstick used on 38 Qxey would thus be “considered” and “abuse” !

    THE DEPARTED HAS EXPRESSED DETEST of his private residency in living past is to be trampled upon by unwanted visitors. Leaving the basement dining room with all its furniture in there DO EXACTLY THAT OFFENCE against his LAST UNFINISHED BUSINESS request.

    The basement dining room below has got NO foundation. Over time, sedimentation will see increasing cracks as human traffic adds to soil instability.It won’t last. And it also disgusts the wishes of the departed prior owner.

    A better solution would be to construct an extension to national museum, remove all furniture in that dining room and displayed them there in secure and well-maintained environment. Visitors to that dining room will also get to see the other displays of our national historical past.

    The demolished site could then be left as a children playground but with a notice that our first PM once lived in that location. After all, the surrounding ambience in that location HAS COMPLETELY CHANGED since the prior owner bought it more than one century ago.It is like a fish out of the water with just the dinner room in place and the structure above that all gone.

    THE OTHER RELEVANT CONSIDERATION IS THIS – was the present owner TOLD of the alleged heritage value inviting more than curiosity interest from any official quarters? Or was that bought by LHY on caveat emptor (buy at your own risks of silence from officialdom – that is, it is a landmine of no redevelopment potential or of their relevant consideration perhaps building another structure of his own interest – such a public library etc which could even have a memorial record of his late father having once lived there?

    Was the existence of a cabinet committee deliberating in matter relating to 38 Oxley Road told to LHY before the purchase? When was it made known to the LHY of this committee existence and its terms of reference and purpose disclosed to the proper owner?

    Was there any intention by the Ministry of National Development to acquire back the said property – perhaps against the wishes of the rightful owner and what compensation he might receives from that compulsory acquisition – be that $1 or $XY million?

    Was the land on which 38 Oxley Road freehold land and what rights attached thereto that might or might not frustrate acquisition (maybe protest rights against such move from the rightful owner) and what compensation in accordance with recent case history.

    THERE IS A LOT OF UNKNOWN & MYSTERIES WAITING TO BE UNWRAPPED IN THIS SAGA – official information comes in drips of droplets of medicine feed as if the “patient” (read society) is dying in the intensive care unit of a hospital.

    I AM NOT AWARE OF ANY NATIONAL HERITAGE LAW passed through Parliament, so any deliberations reached by the Cabinet Committee with regards to 38 Oxley Road is NOT law,

    Law is made in Parliament, not made in the secretive deliberation of any Parliamentary Committee – otherwise why should we taxpayer paid so expensively for so many MPs, Nominated MPs, NCMP?

    If any part of the Executive including Parliamentary Committee wayanging is law determination, WE DON’T EVEN NEED TO EMPLOY AND PAY A LAW MINISTER. In fact, he can be let go and he will EARN FAR FAR MORE IN PRIVATE PRACTICE.

    TCH needs to explain why we taxpayers have to pay stupidly for the IRRELEVANCE AND LAW FUTILITY of what is in reality going to be a no-law abiding CURIOSITY AND DELIBERATION of any Parliamentary Committee.

    And cabinet have to explain why its curiosity extends only 38 Oxley Road when plenty of heritage structures elsewhere have been torn down without a blink of the eyelid.

    Even Keong Siak Road has got colorful heritage value of past history as a red-light district but now has other business of culinary pleasure taken over and hidden its charming sensual pleasure past.

    Let’s go with the flow of changing times might be the best way forward whilst accord to the wishes of the departed previous owner.

    What comes across clearly in these seeimgly interminable exchanges in the famiLEE squabble and now spreading to other ministers is the obsession with being proven RIGHT at all costs. This is a typical Singapore mentality. It shaped it response to the ‘islands’ dispute, and the the TERREX situation. Never mind if it permanently damages already frayed relationships even within family members. It reflects, once again a deep insecurity and associated incapacity to smile, perhaps sheepishly, and let it pass even if you know/believe you are right or the accusations are unjustified.

    Not that I like her very much, but Theresa May has been villified following the horrors of the Grenfell Tower fire in which over 70 people are now feared missing or dead. The anger of the people is understandable, but she bore the brunt of their wrath (unfaily in my view) and rightly chose not to defend her actions when she viaited the scene of devastation and talked to police and officials rather than the people affected and was criticised for being unfeeling and out of touch. It must have hurt her, but she shrugged it off like water off a duck’s back.

    What these two instances show is the difference in maturity and hence ability to ruse ABOVE legalistic interpretations and justification, so-called ‘rule of law’ and to understand that ultimately such rules are intended to AID the development of stable and trusting relationships. Paradoxically the need to resort to the letter of the law carries with the implication that independent arbitration is needed because both parties don’t TRUST each other.

    When there is a need to recourse to the courts, there will not be any real winners (excluding the lawyers themselves).

    Quite ironically, by emphasising tight control though laws and regulations, LKY unwittingly helped to purge out the very TRUST that is needed to lubricate long term relationships among the government and the governed and niw even among siblings. The spectacular success of the very systems and instituions he created are niw threatening to undo all his schievements. The unintended consequences of his policies and practices are now coming back to haunt his own children, pitting each agains the other in a battle no one will win. The sociologist Robert Merton identifed what he called the ‘imperious immediacy of interest’ as the generative cause of unintended consequences. Obsession with wanting to get thing right in the short term and yo control outcomes tightly breeds longer term unanticipated outcomes. You can see this in his ‘stop at two’ policies, graduate mothers etc etc. And now his dynasty is beginning to crumble under the weight of its own internal contradictions.

    THE BACKSTABBING in this escalating feud just keep escalating like a prairie fire – the more the contradictory interventions from official government quarters, the bigger the flame they fan of lost public credibility and distrust of official pronouncement of the evolving palace intrigue.

    The entire PAPpy lost sheep seems to have all fallen into a hole and they are all digging furiously deeper and deeper of this quagmire which is likely to escalate into a point beyond which they have no escape route (if they have not yet past beyond this point of retrieval loss).

    THE OTHER RELEVANT CONSIDERATION IS THIS – was the present owner TOLD of the alleged heritage value inviting more than curiosity interest from any official quarters? Or was that bought by LHY on caveat emptor (buy at your own risks of silence from officialdom – that is, it is a landmine of no redevelopment potential or of their relevant consideration perhaps building another structure of his own interest – such a public library etc which could even have a memorial record of his late father having once lived there?

    Was the existence of a cabinet committee deliberating in matter relating to 38 Oxley Road told to LHY before the purchase? When was it made known to the LHY of this committee existence and its terms of reference and purpose disclosed to the proper owner?

    Was there any intention by the Ministry of National Development to acquire back the said property – perhaps against the wishes of the rightful owner and what compensation he might receives from that compulsory acquisition – be that $1 or $XY million?

    Was the land on which 38 Oxley Road freehold land and what rights attached thereto that might or might not frustrate acquisition (maybe protest rights against such move from the rightful owner) and what compensation in accordance with recent case history.

    THERE IS A LOT OF UNKNOWN & MYSTERIES WAITING TO BE UNWRAPPED IN THIS SAGA – official information comes in drips of droplets of medicine feed as if the “patient” (read society) is dying in the intensive care unit of a hospital.

    If the GOVT is so interested in 38 Oxley allow the will to be EXECUTED..buy the land from public auction and built a Replica to Worship in like the Shrine in Tokyo where Japanese soldiers slaughtering Singaporeans are interred after all LKY work for the interred ones and maybe can bring one or two to Oxley too plus the ashes of traitors in WW2

    If all the gov care is to avoid something unpleasant to build over the piece of land after the house is being demolished, then the gov can simply inform the Lee family that the gov would like to purchase the piece of empty land once house is demolished or simply put the gov will always have the first bidder right when the land is put up in the open market.
    I just cannot understand why a simple decision that requires the gov to form a ministerial committee consisted of 4 million dollars ministers with no decision has been reached after one year of deliberating. What a shame to the intelligent level of these ministers. I seriously doubt if we have the right minded leaders to run the country.
