Li ShengWu clarifies private post after ‘threat’ from AGC

Li ShengWu has amended a post he made on 15th July and posted further clarification after he supposedly received a ‘threatening letter’ from the Attorney-General Chambers (AGC).

Mr Li, who is the eldest son of Mr Lee Hsien Yang, had shared on his Facebook a link to a Wall Street Journal article, commenting that the article can be a good summary on the famiLEE dispute for those who may have been watching the saga from a distance.

The Wall Street Journal article had offered a thorough analysis of the famiLEE saga, its consequences and implications.

Mr Li had also commented:

Keep in mind, of course that the Singapore government is very litigious and has a pliant court system. This constrains what the international media can usually report.

The post, which was made in a private friends-only mode attracted the attention of the AGC which said that it was “looking into it“.

It appears that the AGC has now concluded that Mr Li’s post may be in contempt of court and have written to him threatening legal action if Mr Li left the post as it is.

Probably under pressure from the AGC, Mr Li has decided to clarify the context of his first private Facebook post.

In a statement released on his Facebook page today (4 Aug), Mr Li reiterated his criticisms of mainstream media coverage of his private post and elaborated on the meaning of his original comments.

On 15 July 2017, I made a posting on a “friends only” privacy setting, for the purpose of sharing a summary by the Wall Street Journal of the political crisis in Singapore. I also added a link to an editorial by the New York Times.

An unauthorized screenshot of my private post was however taken, and given to others that did not have access to my private post. Without my approval, the unauthorized screenshot of my private post, or content from my private post, was published and republished by others, including by Singapore’s mainstream media.

The Singapore Attorney General’s Chambers then sent me a threatening letter saying that my private post is an attack on the Singapore judiciary and is in contempt of court. It is not.

No one who published or republished my private post had approached me to clarify what I meant. Curiously, the Singapore media had time to seek statements from a Senior Minister of State and the AGC, but did not even do basic fact-checking – they inaccurately reported that the post was taken down, because they did not bother to contact me.

If my private post is read in context, it is evident that I did not attack the Singapore judiciary. In the context of sharing the summary by the Wall Street Journal, I intended to convey that the international media were restricted in their ability to report on the recent crisis, due to the litigious nature of the Singapore government, and the different legal rules with respect to press freedom in Singapore as compared to countries such as the United States. There is also flexibility in Singapore’s defamation laws – they just have different boundaries from the defamation laws in other jurisdictions. The government makes use of these legal rules to restrict unfavourable reporting.

It is not my intent to attack the Singapore judiciary or to undermine public confidence in the administration of justice. Any criticism I made is of the Singapore government’s litigious nature, and its use of legal rules and actions to stifle the free press. However, to avoid any misunderstanding of my original private post, I have amended the post so as to clarify my meaning.

Meanwhile Mr Li’s father and his aunt, Dr Lee Wei Ling have kept to their end of the conditional ceasefire agreement and refrained from posting more allegations on social media.

It remains to be seen if they will keep their silence any longer should the AGC proceed with further action against Mr Li as he has not removed the supposedly offending post, which AGC probably would have demanded.

    2. Who had directed the AGC to look into it?

    3. Who had told the AGC to write the threatening letter to LSW?

    4. Why is the AGC, which is part of the Executive Branch of Government taking action instead of the Independent Judiciary Branch, if the matter is regarded as an attack upon the Singapore Judiciary and/or contempt of court?

    It would be interesting to get answers to the above questions. If it is in the USA, all the answers would come out in a matter of time. But in Singapore, most probably we would never know.

    Like former NUS law lecturer Malaysian Tey Tsun Hang accused of corruptly obtaining sex and gifts from his former student, as an inducement to give her better grades? Of course, he lost his PR status when he left the country without a re-entry permit.

    “The damage has been cruelly – with the way the Singapore mainstream media reporting was conducted – and irreversibly inflicted on my integrity, academic career, and academic future, and most importantly, my credibility as an academic critic of the Singapore system,” he wrote.

    Previous commentary speculated Tey could have been prosecuted in part because of a book he wrote criticising Singapore’s judiciary.

    Legal Consensus—Surpreme Executive, Supine Jurisprudence, Suppliant Profession of Singapore was published in end 2011 by the Hong Kong University. In it, Tey wrote about numerous defamation suits the ruling People’s Action Party had levelled against its critics in order to silence them.

    In the book, he also referred to clashes between the government and the Law Society in the 1980s, and voiced his belief that the Law Society had its role and authority diminished over the years, amid the rise of the Singapore Academy of Law, part of a plan to divide the legal profession and an exercise of co-option.

    The AGC seems bent on securing the creditability of our Judiciary from slurs against it as allegedly contained in LHY’s son’s postings. Then the more basic thing to do should be to advise government to not only claim the “independence” of the judiciary, but also to make it obvious it is independent, ie. by separating it administratively from itself. Of course, this would still have limited effect, given LKY’s history of being able to make JBJ “crawl and beg for mercy” because “we control everywhere”. People would still suspect that even an administratively independent judiciary would still be under psychological control. Despite that, the move would be some start on making our judiciary indisputable. As it is, such legal action as threatened against nephew Lee would only confirm in doubters’ mind the very thing he is accused of alleging.

    It is notable that Sheng Wu did not change his views or remove his post. He clarified his point and as I understand it his earlier remarks were directed at the readers of his post when reading the article about Singapore in the WSJ.

    It is more about the nature of the article that readers should read with the awareness of self censoreship by editors and therefore may have been diluted or facts glossed over.

    The fact is that when Singaporeans and the AGC reads it, they immediately think it was a reference to them. That is the reaction of the guilty–not of the innocent. So the AGC has implicated themselves to admit that the description as apt in referring to them. The only thing is that while one knows the truth, one must not openly say it is true.
