SDP to consider legal proceedings to compel government to call for by-election in Marsiling-Yew Tee

Ms Halimah Yacob has announced that she will contest in the coming Presidential Elections and has resigned as MP for the Marsiling-Yew Tee GRC.

The GRC system was introduced in 1988, the official reason being “to ensure that Singapore’s parliament would always be multiracial in composition and representation.” As such, the constitution requires that GRC teams include at least one member from a minority community.

Given this rationale, Ms Halimah’s stepping down as MP runs counter to the essence of the GRC system both in letter and spirit. Her resignation must necessarily trigger a by-election in Marsiling-Yew Tee.

The government determines the number of GRCs needed at any one general election necessary for fair representation. If the government can remove a minority MP at will after he/she is elected, why set the number of GRCs – and therefore the number of minority MPs – to be contested in the first place?

In addition, the government stipulates the particular ethnic representation for a particular GRC so as to ensure that the ethnic community in that GRC is adequately and effectively represented. By removing that MP, is the government not also removing that community’s representation in Parliament?

To be clear, Ms Halimah’s resignation is a deliberate and calculated ploy by the PAP to remove one of its MPs in order that she may stand for another election. The PAP cannot be allowed to vacate elected Parliamentary seats just to maximise its electoral chances for another office. It is an abuse of the system and makes a mockery of the general elections.

If the PAP insists on taking such a step, it must abide by the rule of law and call for a by-election. It cannot have its cake and eat it too.

Minister Chan Chun Sing says, however, that no by-election will be held if Ms Halimah were to resign from her seat. Such a unilateral and unconstitutional measure runs counter to the concept of the GRC system and must be challenged.

To this end, the SDP will actively explore legal remedies to ensure that the PAP does not willy-nilly change rules or interpret the law to suit its own political ends by calling for a by-election in Marsiling-Yew Tee.

    Yes I want to see SDP explore legal remedies to force the BE.

    The nonsense about racial representation is just PAP playing the race card. If it is really looking after the various races why must it be so special to have the same race help each other, what is wrong with another race helping? Have Singaporeans forgotten that we are all citizens regardless of race, language and religion?

    And to actually read hear that clown keechiu say a BE is not necessary is just unbelievable. Not surprised he kept very quiet and none of his party people came out to defend him after that, they know it’s a no win situation for them.

    There is no excuse the PAP can use for this one so let’s see how this ends.

Other Opposition parties will not contest to avoid 3-corner fights. The minority residents in Marsiling-Yew Tee GRC are deprived and are no longer represented now that Halimah Yacob has resigned. The PAP government’s refusal to hold a by-election is unfair, unconstitutional and is an act of sheer cowardice.

How dangerous it would be if in future GE, any opposition party which fall short of a minority race candidate would resort to simply ‘borrowing’ a minority race singaporean to temporarily make up a GRC team. If the team wins, the minority race MP would resign later. Since there’s no requirement to hold a by-election in a PAP ward, why is there a need to have one in the opposition ward?

    A by-election is required in the marshaling-yew tee constituency! This is all the more so because the minority mp chooses to resign from her job. She did not die in office and as such there is no reason not to call for a by-election.

    The election laws would be breached under the group representative constituency if the position is not filled by a by-elections.

    In law-abiding Singapore, it is thus necessary to comply with the Rule of Law just like The Hague arbitration on the South China Sea.

    Not holding a by-elections would mean that the minority citizens of marshaling-yew tee are not served from now till 2020!

    It is only right that residents of marshiling-yew tee make a police report or a magistrate’s complaint if no by-elections is declared!

    It is stated clearly in the Parliamentary Elections Act that a minority candidate MUST be represented in a GRC!
    You can read this in the Singapore statues.

    Any party without a minority candidate can try submitting such applications during a GE and see whether your application is thrown out as null n void!

    Another question: If one MP of the AHTC were unable to complete his/her term of office, can LTK then appoint a WP grassroot advisor to fill that post?

    I think the answer is obvious and the 49+% of voters in AHTC will not accept that!
    So why should the voters of Ms Halimas’ previous constituency agree and accept a grassroot advisor APPOINTED to take over her place?
    In this democracy an MP is an elected officer with constitutional DUTIES and POWER. A grassroot advisor is a nobody in our parliamentary system!
