Amended CLTPA passed with strong opposition from Workers Party

A four-hour debate took place in Parliament on Tuesday (6th Feb) with 11 MPs speaking on the Criminal Law (Temporary Provisions) Bill (CLTPA), which will expire in 20 months’ time in October 2019

The proposed renewal and amendments to the CLTPA will allow for greater powers by the Minister of Home Affairs.

Increased scope of Minister’s Powers

Previously, the list of offences under the bill were not spelled out and reference was made only to Section 30 of the CLTPA which lays out the powers of the minister to make decisions on police supervision orders and detention orders.

Following a decision by the Court of Appeal to release match-fixing kingpin Dan Tan on the basis that his activities did not pose a threat to Public safety, the CLTPA will be amended to include an additional list of offences that include secret society activities, unlicensed money-lending, drug trafficking, kidnapping and organised crime.

In addition, the amendments include a new clause which makes the Home Affairs Minister’s decision final and cannot be appealed against.

Strong opposition from the Workers Party

Arguing against the proposed amendments, Mr. Pritam Singh of the Workers Party (WP) said that the “finality clause” would limit judicial review as it stops the courts from looking into the facts of the case. He added that the “prospect of locking people up for an undetermined duration is incongruous with the rule of law”.

Echoing the same sentiments, WP Chairman Ms. Sylvia Lim said that the “government has gone too far” in the proposed changes and the changes would make the minister a global policeman, with “no equal in the world”.

Yes, the current Act does not list which kind of activities make a person liable to be detained. But that does not mean the Minister currently has carte blanche to detain anyone he pleases.

The Schedule will likely short-circuit the assessment process of cases suitable for detention, and maybe enable the Minister to bypass answering questions such as whether cases are serious enough, or why it’s not possible to prosecute these persons in court.

Also, the Bill potentially allows for persons to be detained for alleged activities of more minor nature, now there is a list of defined activities.

Ms Lim added that an amendment to the bill now includes “participation in or facilitation of an organised crime activity (OCA)” as one of the offences chargeable under the CLTPA.

This, Ms Lim felt would would mean that the CLTPA can be used to include activities done overseas or activities that “may not pose a threat to public order in Singapore”:

This expansion of the kind of activities subject to the Act in effect makes the Minister a global policeman with no equal in the world. This is a position too arrogant for the House to support.

Agreeing, NCMP Denis Tan said that “To take away someone’s liberty like this is not something we should take lightly”.

Amended CLTPA passed with strong opposition from the Worker’s Party 

The proposed amendment to the CLTPA was eventually passsed with 10 voting against and 2 abstaining.

Of the 89 MPs present, all eight MPs from the WP voted against,  2 Nominated Members of Parliament (NMPs) voted against and 2 NMPs Azmoon Ahmad and Kok Heng Leun  abstained.

Since the PAP whip was not lifted for this session, all MPs from the People’s Action Party are required to vote for the amendment, which they did.

Amended CLTPA in a nutshell

The new CLTPA allows for detentions without trial if the Home Affairs Minister deem such detentions necessary in the interests of “public safety, peace and good order” for an indefinite period of time and cannot be appealed.

    PAP already has ISA to detain anyone who pose a secret threat, now it wants to be able to detain anyone without any evidence and a fair trial.

    In 2011 general election, the Workers’ Party said that specific anti-terrorism and anti-espionage laws, which allow arrests and detention without trial only under strict conditions, should be enacted to replace the ISA.

    Now 2018, we see that PAP not only fail to listen, they want more power.

    We are going back to time where the village head decide on dispute. The village head could put criminal in pig basket and throw them into river or stoned to dead.

    The new pap devised ISA laws should get the approval by Natioal Referendum and not by PAP with their absolute control ofvthe Parliament. AGC and Suprme Court Judges should by their power vested in them demand so as this is their sacred duty and so called independence guaranteed by the Constitution. Wouldn’t they have failed the citizenry in helping to protect the citizenry thru the Constitution and their oaeh of office they have sworn on their faith.
    Justice is justice and protection of it is divine presumably why each high office bearer has to swear on his/her faith before assuming office.
    What has hapoened in Parliament has the sibling’s cry of heplessness in the kingdom laboriously built by their father. Surprising but not if one looked into dynasty history.
